EXCLUSIVE: Stop-and-Frisk Lawsuit May Lead to Federal Monitor For NYPD

The Daily News has learned that U.S. Attorney General Eric Holder is considering asking the trial judge to provide independent oversight for the police if stop-and-frisk is deemed unconstitutional.
The Department of Justice would support the appointment of a monitor with Manhattan Federal Judge Shira Sheindlin making the choice, sources said.
Holder's Assistant Attorney General for Civil Rights, Thomas Perez, made a Wednesday call to City Hall with word that the feds planned to intervene in the controversial, long-running suit.
Perez delivered the decision one day after Mayor Bloomberg and Police Commissioner Ray Kelly vigorously objected to the plan in telephone conversations with Holder, according to well-placed sources.
As of Wednesday afternoon, no additional papers were filed in court on the case. The trial concluded on May 20.
After presiding over a two-month trial, Scheindlin has yet to rule on the constitutionality of the NYPD program of stopping, questioning and sometimes frisking individuals when police suspect criminality.
Civil rights lawyers argued in the case that police have been stopping more than 500,000 New Yorkers a year, the vast majority blacks and Hispanics, without proper cause.
Disputing the accusation, the NYPD contended that the racial and ethnic breakdown of those stopped mirrored the breakdown of criminal suspects and victims.
Holder's contemplated action stunned City Hall because the Justice Department showed no interest in weighing in on the case until after Scheindlin began to formulate her ruling.
**If this goes through, cops should stop making stop and frisk interviews and let the animals kill each other. NYC will become another killing field like Chicago.
