Our appeal has been assigned to Judge Arthur Diamond, the same judge who denied the injunction on the wage freeze, the same judge that ruled against the Garden City Firefighters union when their contract got violated. We will never get a fair impartial shake from anyone, you would at least figure our union would see that there is no way this judge can be impartial but instead they are just stuffing there faces day in and day out.

Now did anybody think we would get a "fair" shake in state court?? This is a slam dunk for the County and Nifa. Nifa knew this all along. They know in state court its a 1 sided case. This is why i have been saying to stop wasting everybody's time with semantics and skip State court altogether and let Wexler rule on the arguments. Its all a shvt show anyway. Just sit back and lets see how many people the County can hire. Its our only chance to get anything done if they cant get the number of recruits they want.... Also id like to know how any judge can allow a county to hire new people and take on additional payroll when in a "pay freeze".... Doesnt sound logical to me or "fair".... I guess this is the new America

I guess this is the new America Wexler won't rule on the arguments until State Court makes a decision. I can predict now what's going to happen- We are going to lose in state court, then lose in the State court of appeals, then we're going to appeal again to Federal Court. It'll wind up back on Wexler's desk and he'll give the same ruling as before, that they had no power and thus, violated the 10th Amendment of the Constitution. That'll take, what? 5-6 years? Our best bet is going to be a deal and the county and NIFA know this.

I don't think the state court case will take as long as the federal one. The only argument we are making in state court is that the interim finance period had expired, thus nifa is unable to impose a wage freeze. I don't think this will require a lenghthy discovery period nor depositions of mangano, etc like the federal one did.
But on the subject of state courts, yeah we're probably screwed no matter who the judge is because state judges are said to be influenced by politics and lobbyists due to many of them (including the one assigned our case) being elected.

No Wexler asked what we were doing about the State Court. He asked if we were pursuing the "state" issue. If we were to pursue it then Wexler stated he wouldnt rule on the other arguments until the State issue was settled. If the PBA bypassed the state issue Judge Wexler wouldve reviewed the other issues. Maybe im wrong but to me the state issue is dead. I seriously doubt it'll go against the "state" NIFA panel
