Judge upholds Suffolk pact for sheriff patrols of LIE, SunriseA State Supreme Court justice has upheld a 2011 agreement meant to keep Suffolk County deputy sheriffs patrolling the Long Island Expressway and Sunrise Highway, and has ordered the issue to binding arbitration for final resolution. In a seven-page ruling, Justice Peter Mayer called it a "valid agreement," largely because the county had used $4 million in savings from the pact in the 2012 and 2013 budgets, while claiming the agreement was invalid. Mayer ordered arbitration because the original agreement called for the process in the event of disputes. "We're very pleased. We think the judge made the right decision," said John Becker, president of the 260-member deputy sheriffs union. Becker expressed confidence that the ruling ultimately could return deputies to highway patrols, although he said he was "willing to negotiate the issue" with the county. Justin Meyers, a spokesman for Suffolk County Executive Steve Bellone, said the county will appeal Mayer's ruling, issued Feb. 27. County police will continue to patrol the highways because under state law an appeal by the county stops the decision from taking effect until appeals are exhausted. Suffolk Police Benevolent Association president Noel DeGerolamo, a defendant in the case, said he was "not surprised" by the outcome. "I knew there was a possibility of the decision going either way, but we'll exercise every right under the law, and I'm confident that the county will do the same," DeGerolamo said. The ruling is the latest twist in a long battle that began in 2008 when then-County Executive Steve Levy ordered lower-paid deputies to take over patrols of the expressway and Sunrise Highway from the police highway patrol as a cost-saving measure. Just before leaving office, Levy in 2011 made the memorandum of agreement with the deputies union, in which the county promised to protect all existing deputy job functions -- including highway patrols -- through 2017. In return, the union agreed to defer $4 million of $8 million in retroactive pay increases until 2015. Bellone, who won election in 2011 with support of the police union, signed a new contract with the police union in September 2012 that returned highway patrol work to them. The sheriff's deputies then sued to enforce their earlier agreement. County attorneys said the deputies' agreement was invalid because the Suffolk Legislature never ratified it. However, Mayer ruled that by never returning the deal's savings to the union, "the county's conduct constituted a ratification and de facto approval of the 2011 MOA." In another matter, Meyers said the administration will allow Sheriff Vincent DeMarco to fill 18 budgeted positions to promote supervisors and investigators. The decision came after DeMarco and Bellone met Friday. Meyers said DeMarco "made the case" hirings would curtail overtime. Meyers said the administration will monitor overtime.

levy WAS & IS the BIGGEST DOUCHEBAG, he HATES the PD and this was his way of screwing with them, in the end the County WILL prevail and the SCABS WILL continue serving bologna sandwiches on white with milk.

You have to look at the big picture. The Sheriffs union (they are a union like us) filed a lawsuit against the county for a contractual agreement that was made. Forget that it puts a conflict between the PD and the Sheriffs. That's not the big picture...The big picture is they won against the county for a binding contract, and in the contract they have any disagreements would be arbitrated...That's a big win for the union, any union against the county. Another reason to let our lawsuit takes its course.

Like rabbit said, Levy is an a$$hole for messing with PD because of his hatred for them. HOWEVER, the Sheriffs were given a contract and then had that contract broken by the county. Sounds awfully similar to something else...
The Sheriffs should get the money that was deferred til 2015 up front. Given the way politics work though, they probably won't see it til 2018 while it's tied up in court! lol

Fukk the Deputies. They scabbed the job initially, knowing they were taking other cops jobs / duties away. I could give two shvts if they never see the $$. You guys in NCPD have the Bayville Agreement in place to avoid a situation like that.
Steve Levy is a complete POS and hopefully someday goes to jail.

Given the way politics work though, they probably won't see it til 2018 while it's tied up in court! lol Actually the SCABS were NEVER given a contract because whatever agreement they came to with the Douchebag levy was NEVER presented to or approved by the legislature, hence NO contract. The judge sounds like a LIBTARD and is trying to say that because the county held the monies from the SCABS that that makes the "AGREEMENT with the Douchebag" (NOT CONTRACT) binding, if that's the case give the SCABS back the money with interest & they can continue serving their bologna sandwiches on white w/milk. |

SCABS are non union workers taking jobs away from union workers. So you are saying the sheriffs dept of Suffolk are not union??? or is there a personal interest at stake? Seems here in Nassau we are all trying to stand together against common enemies.....nifa, mangano (the county) and friends.

OK then what happened during hurricane Sandy when outside agencies from all over took over the JOBS of NASSAU COUNTY PD??? Not a word was spoken against it. |

The big picture is they won against the county for a binding contract, and in the contract they have any disagreements would be arbitrated. That's a big win for the union, any union against the county. Another reason to let our lawsuit takes its course. It's funny you say "the big picture" because that's not what you're looking at, you actually have a very myopic point of view on this. The WHOLE issue stemmed from levy (from here on known as "The Douchebag") having a bug up his ass about the SCPD, he tried Several different ways to screw with them, he finally found one & this was it. His statement regarding this as a cost cutting measure WAS/IS Total BS, the SCAB's were padding their pensions dramatically because they didn't have the manpower in place to handle this new assignment. The Douchebag spent hundreds of thousands of county dollars on upgrading the SCAB's equipment to handle this new assignment which the SCPD already had. Prior to this coming to fruition The Douchebag had already agreed to this behind the scenes with the president of the ONLY LE union (the SCABS) that backed him. Unfortunately, we had a worm of a commissioner who was not only a pusillanimous sycophant but also lost in his own little world of make believe. The Big picture IS this has NOTHING to do with the SCABS and ALL to do with a little miscreant, The Douchebag, having a vendetta against the SCPD and going all out to see it come through. This "agreement" that is being discussed now was concocted AFTER The Douchebag was caught redhanded and forced to give up his 4.1 million dollar reelection campaign war chest with a promise that he will no longer run for public office in Suffolk County. This current "agreement" that is being discussed about the SCABS was The Douchebag's last ditch effort to continue his ways of sticking it to the SCPD. I've heard several SCABS say that they were/are not interested in patrolling the Hwy's yet their union seems fixed on trying to attain this, either both of them are lying or one isn't being truthful with the other. So, I say give the SCABS back the money they allowed to county to withhold plus interest and say au revoir. |

Yes I remember the news articles on that, and also levy aka duchebag, changed party lines to add insult to injury, and you bring up a good point with the Sheriffs dept. The union wanted something that the membership didn't as you quoted what some membership stated. Most of what any politician says about cost cutting is a complete pile of shvt, and they have an agenda, sorta sounds like the situation in Nassau of the union telling the members...take this deal or else...I haven't seen any details so, I will hold my complete comment to after all the finer details are announced. Many times the devil is in the details, what's seems great on top and at first glance turns into a nightmare. Time will tell. But regardless, the judge stood with the union. Scabs or not, they are a union, we are a union and I'm sure if you ask other unions what they think about us it's probably not flattering either. |

I mean what you're using as an example is UTTERLY RIDICULOUS, in times of Catastrophic Emergencies such as Hurricane Sandy or say 9/11 those lines NO longer exist, the bottom line in those situations is to Help people out Not get your panties all in a bunch because some other agency handled a job that under NORMAL circumstances would be handled by your agency. What is being spoken about in this thread has Nothing to do with the example you just provided. |
