The original legal dispute that led to yesterday’s damage award dates to 1989 and concerned revocation of previously approved building permits to construct condominium towers on property owned by Belair Building LLC (owned by Haberman) at 350 Shore Road in Long Beach. The Long Beach City Zoning Board revoked the permits based upon its determination that the builder had not abided by a previous stipulation of settlement between the parties, but Haberman sued and won, the City appealed, and the NYS Appellate Court denied the City’s appeal in 2017.
In the intervening years the parties have litigated the damage claim, which resulted in the $131 million damage award announced yesterday. In its defense at the trial, which included a number of subject matter experts, the City argued against the award of any damages.
“This case has been hanging over the heads of our City’s residents for the past three decades, waiting for financial resolution, especially since 2017 when the City lost the case,” said Ms. Gayden. “Now that the court has rendered its decision, we must respond with urgency and expert planning to protect our community’s interests.”
